Most families think a will keeps things simple. It usually does the opposite…
A lot of people believe a will avoids court, but a will actually sends everything there. Probate is not optional—it is required. Wills are essentially letters to the probate judge, which means delays, legal fees, executor costs, and your finances becoming public record. The bigger the estate, the longer it often takes, and during emotional moments, that delay creates stress and conflict.
Wills also encourage lawsuits, because anyone unhappy sees it all and can question intent, capacity, or fairness—especially in blended families. All of this happens even when parents just wanted the best for their family.
The critical takeaway?
Wills guarantee probate and invite disputes. Lifetime planning avoids both. Trusts and other structures control assets privately, efficiently, and without court involvement. A will invites a free-for-all; a properly built plan protects families.
