Not only can trusts avoid the expense, public exposure and risk of probate – which is a court proceeding – they can also help ensure that your inheritance wishes are honored, especially important in cases where one spouse dies and the other eventually remarries and you want to make sure the children are not unintentionally disinherited. They are also great for protecting the interests of kids from previous marriages.

Trusts can also be very effective asset protection tools (but see our Asset Protection class for more detail and pitfalls to avoid), and when properly designed can help avoid massive estate taxes and other inheritance perils.

We also cover wills, powers of attorney (POAs), living wills, health care surrogates and health care powers of attorney, Lady Bird deeds, and trust protectors – and often overlooked but tremendously important trust function that many trust documents lack.
